Terms of Service
§ 1 Introduction
These Terms of Service set out the rules for purchasing and using the products offered by the Seller, including how the contract is concluded, payment methods, complaints, copyright and personal data.
The products offered through melodygifted.com are owned by PHU Paweł Kobus, Korpele 31b, 12-100 Korpele, Poland, tax ID (NIP): 7451856801.
By placing an order, the Customer confirms that they have read and accept these Terms of Service.
§ 2 Definitions
- Terms – this document, setting out the rules for the sale of Products through the Website.
- Customer – a natural person with full legal capacity, a legal entity, or an organizational unit without legal personality.
- Consumer – a Customer who is a natural person entering into the contract for purposes not related to their business activity.
- Website – the website at melodygifted.com.
- Product – a personalized song created from the information provided by the Customer, delivered as an MP3 file to the email address provided.

- Order – the Customer's declaration of intent to conclude the contract, specifying the selected package and the details needed to create the song.
- Contract – the legal relationship between the Seller and the Customer related to the purchase of the Product.
§ 3 Concluding the Contract
An Order is placed by completing the form at /order — the Customer provides information about the person receiving the song (name, relationship, occasion, music style, memories), selects a package and provides an email address for delivery.
Before the Order is accepted, the Customer is informed of the main features of the Product, the total price and the delivery time. The Order becomes binding once payment is received. The Contract is concluded when the Order is accepted, which the Customer is informed of by a confirmation email.
The Customer is required to provide accurate information. An Order containing incorrect information may not be fulfilled.
§ 4 Prices and Payments
Prices are final prices in the currency shown in the store. Available packages: Standard and Express.
Payments are processed by Przelewy24 and Shopify Payments. We accept Visa and Mastercard cards and bank transfers. Delivery of the Product is free of charge.
The Seller reserves the right to change prices and run promotions. Changes do not apply to Orders placed before they take effect.
§ 5 Order Fulfillment
The Order is fulfilled after payment is received. Delivery times:
- Standard package – within 5 business days
- Express package – within 24 hours
The finished song is delivered to the email address provided in the form.
§ 6 Copyright
The song created is an original work within the meaning of copyright law. The Customer receives a non-exclusive license for personal use — the song may be played at private celebrations, shared on social media and given as a gift.
Commercial use, resale or reproduction of the song without the Seller's written consent is prohibited. Violations may result in civil or criminal liability.
§ 7 Right of Withdrawal and Satisfaction Guarantee
A Consumer may withdraw from the Contract without giving a reason within 14 days of its conclusion by sending a statement to: contact@melodygifted.com
The right of withdrawal does not apply after the MP3 file has been delivered, if before delivery the Customer agreed to lose this right once the service has been performed.
Regardless of the above, the Seller offers the Customer a voluntary satisfaction guarantee: within 30 days of delivery of the song, the Customer may report dissatisfaction to the Seller's email address, and the Seller will revise the lyrics and the song free of charge. If the revisions do not satisfy the Customer, the Seller will refund the price paid. This guarantee does not exclude or limit the Customer's statutory rights.
Refunds are made within 14 days of receiving the statement, using the same payment method the Consumer used.
§ 8 Complaints
Complaints may be submitted by email to contact@melodygifted.com with a description of the issue. The Seller will respond to the complaint within 14 days of receiving it.
§ 9 Personal Data
Personal data is processed in accordance with the Privacy Policy available at /privacy. Data is collected solely for the purpose of fulfilling the Order.
§ 10 Final Provisions
Matters not covered by these Terms are governed by the Civil Code and the Consumer Rights Act. Consumers may use out-of-court dispute resolution methods, including the ODR platform: ec.europa.eu/consumers/odr
The Seller reserves the right to amend these Terms. Changes do not apply to Orders placed before their effective date.
